Drunk driving is the act of operating or having care or control of a motor vehicle while under the influence of alcohol and/or drugs to the degree that mental and motor skills are impaired. There are a number of powers given to police officer to assist in the enforcement of the offences, and there are a number of presumptions that assist in the prosecution of the offences. The Criminal Code of Canada has two distinct offences that directly addresses drinking and driving. Section 253 makes it illegal to operate a motor vehicle or vessel or operate or assist in the operation of an aircraft or railway equipment, or to have care or control of a motor vehicle, vessel, aircraft, or railway equipment, while that person's ability to operate is impaired by the alcohol, drugs, or a combination of the two.
