The Employee Free Choice Act is a bill presently being considered in the United States Congress. Its text states that it would "amend the National Labor Relations Act to establish an efficient system to enable employees to form, join, or assist labor organizations, to provide for mandatory injunctions for unfair labor practices during organizing efforts, and for other purposes."The latest version was introduced into both chambers of the U.S. Congress on March 10, 2009.In order for a union to be recognized as the official representative for employees in a workplace bargaining unit under current U.S. labor law, the card check process begins when an employee requests blank cards from an existing union, and requests signatures on the cards from his or her colleagues. If at least 30% of the workers in a workplace bargaining unit sign the cards, the employer may request that the National Labor Relations Board hold a secret ballot election to decide whether the workers want to be in a union.
