It was introduced in several U.S. Congresses before its passage in 2010. The law reduced the disparity between United States federal criminal penalties for crack cocaine and powder cocaine offenses from a 100:1 ratio to an 18:1 ratio (based on the number of grams of cocaine in possession) and eliminated the five-year mandatory minimum sentence for simple possession of crack cocaine, among other provisions. The Congressional Budget Office has estimated that implementing the Fair Sentencing Act of 2010 will reduce the prison population by 1,550 person-years over the time period from 2011-2015, creating a monetary savings of $42 million during that period.
