Jay Scott Bybee (born October 27, 1953 in Oakland, California) is a federal judge on the United States Court of Appeals for the Ninth Circuit. He has published numerous articles in law journals and taught law school; his primary interests are in constitutional and administrative law. Bybee is currently the subject of a federal investigation by the Justice Department's Office of Professional Responsibility concerning a legal memorandum (the "Bybee Memo" also known as the "Torture Memo") he authorized while serving in the Office of Legal Counsel during the Bush administration, as well as a subject of a war crimes investigation in Spain.
